The Service is available at the MobileVibes and Zuka website. Part of the Service makes available to you downloadable mobile entertainment, such as ringtones, games and graphics, wallpapers (collectively, the "Downloads"). Once properly registered and after making proper payment, you will be permitted to download to compatible wireless telephones and other compatible devices certain Downloads through the Service. Through the Service, you will also be able to send text messages to retrieve content participate in interactive mobile applications and services.
Parties
In the Terms of Use, "you" includes each individual (including the legal guardian of any individual under the age of 18) who uses MobileVibes and Zuka under any circumstances, regardless of whether more than one individual uses the same phone number.
Revisions
MobileVibes and Zuka may need to change these Terms of Use from time to time. Please be sure to check out a new change every time you see a "Revised Terms of Use" hyperlink on the home page. Each change to the Terms of Use becomes effective as soon as it is posted on this web site. Your use of this web site after the change has been posted means you agree to the change.

License to Download(s)

MobileVibes and Zuka reserves the right to deny service to you, or take any other action it deems appropriate in response to the activities described above, or for other reasons. A user (or the legal guardian of a user under age 18) who engages in the activities listed in (i) through (vi) above is fully liable to MobileVibes and Zuka for all damages caused by such activity, as well as for indemnifying MobileVibes and Zuka from any legal proceedings initiated by third parties, including attorney's fees. Complaints
MobileVibes and Zuka does not screen, monitor, endorse, remove, correct or edit the messages sent by its users. If you notify us by email at admin@up-mobile.com of any concerns you have regarding messages sent or received by means of the MobileVibes and Zuka service, we will attempt to address your complaints. MobileVibes and Zuka may investigate users of the service and their messages, even though it has no responsibility for the actions of either the complainant or the complained-of user. You understand that MobileVibes and Zuka cannot be responsible for the content, frequency, or source of any message you may receive, even if you have complained to us.
